What is Gratuity? Gratuity is a lump sum amount paid by employer to employee as a token of appreciation for services rendered. It’s a retirement benefit under Payment of Gratuity Act, 1972.

Eligibility: You must complete minimum 5 years of continuous service to receive gratuity. Exception: In case of death or disability, gratuity is paid even if service is less than 5 years.

Two Types of Formulas:

  • Covered Under Act (10+ employees): (Basic + DA) × 15 × Years of Service ÷ 26
  • Not Covered (Less than 10): (Basic + DA) × 15 × Years of Service ÷ 30

Maximum Limit: Government has capped maximum gratuity at ₹20,00,000 (20 lakhs). Even if your calculation shows ₹30 lakhs, you’ll get only ₹20 lakhs.

How Does the HR Calculator Work? (The Math)

The Gratuity Calculator uses a highly specific formula. The law dictates that you must be paid 15 days of salary for every completed year of service. Here is how it computes the exact figure.

Isolating the Basic Salary:
The calculator looks ONLY at your last drawn Basic Salary + Dearness Allowance (DA). If your total CTC is ₹1 Lakh/month, but your Basic is ₹40,000, the calculator only uses ₹40,000.

Finding the Daily Wage (The 26-Day Rule):
This is the best part of the law. Instead of dividing your monthly salary by 30 days, the government divides it by 26 days (assuming 4 Sundays as non-working days). This artificially boosts your calculated “daily wage.” (e.g., ₹40,000 / 26 = ₹1,538 per day).

Applying the 15 Days Rule:
The law grants you 15 days of pay for every year you worked. So, it takes your boosted daily wage and multiplies it by 15. (₹1,538 × 15 = ₹23,070 per year worked).

Multiplying by Tenure (The Round-Off):
Finally, it multiplies that number by the total years you worked. If you worked 5 years and 7 months, the law generously rounds it up to 6 years! (₹23,070 × 6 = ₹1,38,420 Total Gratuity).

The Two Different Formulas (Covered vs Not Covered)

The Payment of Gratuity Act, 1972 applies to factories, mines, ports, and companies with 10 or more employees. However, the calculation changes depending on whether your company officially falls under the Act or voluntarily gives Gratuity outside the Act.

✅ The “4 Years and 240 Days” Loophole

Do you actually have to complete exactly 5 years (1,825 days) to get Gratuity? Thanks to a ruling by the Madras High Court, if an employee completes 4 years and 240 days in their 5th year of continuous service, it legally satisfies the 5-year requirement! Check your exact joining date before submitting that resignation.
